These Terms of Service (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the BoostMyReferral website at BoostMyReferral (the "Site") and any related mobile or software applications ("BoostMyReferral Platform"), including but not limited to the delivery of information via the website, whether existing now or in the future, that link to the Terms (collectively, the "Services").
These Terms are effective for all existing and future BoostMyReferral customers.

By accessing or using the BoostMyReferral Platform, you are agreeing to these Terms and concluding a legally binding contract with BoostMyReferral and/or its affiliates. "Customer," "You," or "Your" refers to you, as a customer of the Services. A customer is someone who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, or uploading information, views, or pictures. This includes other persons jointly participating in using the Services.
Content
"Content" includes (but is not limited to) reviews, images, photos, audio, video, location data, nearby places, and all other forms of information or data. "Your Content" or "Customer Content" means content that you upload, share, or transmit to, through, or in connection with the Services, such as likes, ratings, reviews, images, photos, messages, chat communications, profile information, or any other materials that you publicly display or display in your account profile. "BoostMyReferral Content" means content that BoostMyReferral creates and makes available in connection with the Services, including, but not limited to, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports, and other usage-related data in connection with activities associated with your account, and all other elements and components of the Services excluding Your Content and Third-Party Content. "Third-Party Content" means content that comes from parties other than BoostMyReferral or its Customers, such as partners, and is available on the Services.
III. Eligibility to Use the Services
By accessing or using the BoostMyReferral platform, you represent and warrant that you are at least eighteen (18) years of age and are fully able and competent to understand and agree to the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
Compliance with Laws
You agree to comply with all applicable laws and regulations in the country in which you reside when accessing and using the Services. You further agree to use the Services solely in accordance with these Terms and applicable law, and in a manner that does not infringe upon the legal rights of BoostMyReferral or any third party.
IV. Changes to the Terms

You understand and agree that any such translations are provided solely for your convenience, and the English version shall govern the terms of your relationship with BoostMyReferral. In the event of any inconsistencies between the English version and its translated versions, the English version shall prevail.
VI. Provision of Services Offered by BoostMyReferral
BoostMyReferral is committed to continually evolving and improving the user experience and the quality of information provided to our customers. Our goal is to connect you with professionals who can assist with referrals to top companies, giving you a platform to enhance your chances of success. However, it is important to understand that while we strive to facilitate these connections, BoostMyReferral does not guarantee a referral to any company or job placement, nor do we guarantee any specific outcome as a result of using our platform.
No Guarantee of Referral
By utilizing the services of BoostMyReferral, you acknowledge and agree that obtaining a referral through our platform is not guaranteed. The referral process is based on several factors, including but not limited to the qualifications and experience of the individual candidate and the discretion of the referrer. Each referral opportunity depends on the availability of professionals willing to provide their support and the unique circumstances of the hiring organization. We act solely as an intermediary to facilitate connections, but the final decision to offer a referral is at the sole discretion of the individual referrer.
Based on Your Own Information and Submitted Proof
Your ability to receive a referral through BoostMyReferral depends significantly on the information you provide when creating your profile, including your qualifications, experience, and any proof that you submit to support your candidacy. It is essential that you ensure the accuracy and completeness of the details you provide. While we aim to present your profile in the best light possible to potential referrers, we do not guarantee that your application will result in a referral, as the referrer’s decision is influenced by the merits of your profile, professional background, and other individual factors.
Professional Discretion and Availability of Referrers
It is important to note that the professionals on our platform, who are potential referrers, are not obligated to offer referrals. Their decision to recommend a candidate is at their personal discretion, and BoostMyReferral does not control or influence their actions. The success of obtaining a referral depends on factors such as the referrer's judgment, the specific needs of the company they work for, and the alignment of your profile with the roles they are hiring for. Furthermore, referrers are not obliged to provide support for every candidate who approaches them via the BoostMyReferral platform.
Our Role and Limitations
BoostMyReferral is solely an intermediary platform designed to facilitate connections between job seekers and referrers. We are not a recruitment agency, and we do not guarantee any job placements or hiring outcomes. The platform is designed to offer an opportunity for professionals to refer candidates within their network, but we cannot guarantee the success of any referral efforts. The decision-making process and the final outcome are entirely up to the referrer, and we hold no responsibility for the final hiring decisions made by companies or individuals.
Accuracy and Completeness of Submitted Information
To improve your chances of receiving a referral, it is crucial that you submit accurate, detailed, and professional information that truly reflects your skills and career goals. You should ensure that all documents, certifications, or other proof you submit to support your referral request are genuine and verifiable. BoostMyReferral does not verify the authenticity of the proof submitted by users but encourages users to provide reliable and truthful information. Any false information or discrepancies found during the referral process could disqualify you from receiving a referral or having your account deactivated.
Continuous Improvement and Updates
In our ongoing efforts to improve the BoostMyReferral platform and services, we regularly conduct updates and modifications to enhance your user experience. As part of our commitment to innovation, we continually optimize features of the platform, including the way we connect candidates with referrers, adjust the functionalities of our app, and enhance the overall platform interface. While we strive to create a seamless experience, the success of the referral process depends on the factors beyond our control, including the availability and willingness of professionals to refer.
We reserve the right to change, modify, or remove services or features without prior notice, and we encourage users to regularly check for any updates that might impact their use of the platform.
Referral and Incentive ProgramsReferral and Incentive Programs
BoostMyReferral may from time to time introduce referral and incentive-based programs for customers to encourage the sharing of our platform with others. These programs are governed by their respective terms and conditions, and by participating, you agree to abide by these terms as well as the BoostMyReferral platform's overall terms of service. It is important to note that participation in any referral program does not guarantee a successful outcome and is subject to the discretion of those offering the referral.
If BoostMyReferral determines that any customer has violated the terms of the program or engaged in fraudulent or unlawful activities, we reserve the right to suspend or terminate their account and/or revoke any earned credits or points. Moreover, we may modify, cancel, or discontinue these programs without prior notice at our sole discretion.
Promotions, Credits, and Offers
At our discretion, BoostMyReferral may offer credits, promotional codes, or other cashback incentives to customers. These offers may be subject to specific terms and conditions and may be modified, converted, canceled, or discontinued at any time, at our discretion. These offers do not guarantee a referral or job placement, and are merely intended to enhance your overall experience using the platform.
Final Disclaimer
By using BoostMyReferral’s services, you fully acknowledge and accept that our platform is a tool to facilitate connections but does not guarantee a referral or employment outcome. We encourage you to utilize the platform with the understanding that success is contingent upon numerous factors outside of our control. BoostMyReferral is not responsible for the final decisions made by referrers or the companies they represent, and your participation is at your own risk.
VII. PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than the intended and approved purposes. The Site may not be used for any commercial activities except those specifically authorized by us.
As a user of the Site, you agree not to:
  • Systematically collect or retrieve data or content from the Site to create or compile a database, directory, or collection without our written permission.
  • Engage in deceptive, fraudulent, or misleading activities, including attempts to obtain sensitive account information such as passwords.
  • Circumvent, disable, or interfere with security features of the Site, including those that restrict the use or copying of content.
  • Disparage, tarnish, or harm the reputation of the Site or its operators.
  • Use information obtained from the Site to harass, abuse, or harm another person.
  • Misuse our support services or submit false reports of abuse or misconduct.

  • Bypass security measures designed to prevent unauthorized access to the Site.
  • Copy, modify, or reverse engineer the Site’s software or underlying code.
  • Launch, develop, or distribute unauthorized automated systems such as bots, scrapers, or cheat utilities.
  • Use a purchasing agent to conduct transactions on the Site.
  • Collect user information for unsolicited communications or create accounts under false pretenses.
  • Use the Site for competitive or revenue-generating purposes without authorization.
  • Sell or transfer your profile to another party.

VIII. USER GENERATED CONTRIBUTIONS

The Site may provide a chat functionality where users can communicate and exchange messages (“Contributions”). Contributions made in public areas of the Site may be publicly viewable and treated as non-confidential and non-proprietary. However, messages exchanged through private chat are not publicly viewable and are only visible to the participants in the conversation.

By making Contributions, you represent and warrant that:

  • You own or have the necessary rights and permissions to use and authorize others to use your Contributions.
  • Your Contributions do not infringe any third party’s intellectual property rights (e.g., copyrights, trademarks, patents).
  • Your Contributions do not contain unsolicited promotions, spam, or pyramid schemes.
  • Your Contributions are not obscene, defamatory, harassing, violent, or otherwise objectionable.
  • Your Contributions do not ridicule, mock, intimidate, or threaten anyone.
  • Your Contributions comply with applicable laws and do not violate any privacy or publicity rights.
  • Your Contributions do not involve child exploitation or offensive content related to race, gender, or disabilities.
  • Your Contributions do not link to or promote material that violates these Terms and Conditions.

Any violation of these terms may lead to removal of Contributions and suspension or termination of access to the Site.


IX. Content
Ownership of BoostMyReferral Content and Proprietary Rights
a. Exclusive Ownership of BoostMyReferral Content
We are the sole and exclusive copyright owners of the Services and all content associated with BoostMyReferral. We also exclusively own the copyrights, trademarks, service marks, logos, trade names, trade dress, and other intellectual and proprietary rights throughout the world (the "IP Rights") related to our Services and Content. These may be protected by copyright, patent, trademark, and other applicable intellectual property laws. You acknowledge that the Services contain original works developed, compiled, prepared, revised, selected, and arranged by us and others, constituting valuable intellectual property that has been developed through significant time, effort, and financial resources. You also acknowledge that the Services may contain confidential information, and you agree not to disclose such information without our prior written consent.
b. Protection of BoostMyReferral's Proprietary Rights
You agree to protect our proprietary rights and those of others in the Services, both during and after the term of this agreement. You will comply with all reasonable written requests made by us or our licensors and suppliers to protect their rights in the Services. You acknowledge that we (or our licensors) own all legal rights, title, and interest in and to the Services, including the IP Rights, whether those rights are registered or not. You agree not to use any of our trade names, trademarks, service marks, logos, domain names, or other distinctive brand features unless expressly authorized by us in writing.
c. Restrictions on Use of BoostMyReferral Content
You agree not to use any framing techniques to enclose any of our trademarks, logos, or proprietary information, nor to remove or obscure any copyright notices or source identifiers. Any infringement may lead to legal action to seek remedies under applicable laws. You cannot modify, reproduce, publicly display, or exploit any of BoostMyReferral's content in whole or part, except as explicitly authorized by us.
d. Third-Party Rights and Compliance
We make no warranty or representation that your use of the materials on the Services will not infringe the rights of third parties not owned by or affiliated with us. You agree to notify us immediately if you become aware of any claim that our Services infringe upon third-party rights.
Your License to BoostMyReferral Content
a. License Grant
We grant you a personal, limited, non-exclusive, and non-transferable license to access and use the Services as permitted by these Terms. You agree not to use the Services for any unlawful purpose or in a manner inconsistent with these Terms. The information available on the Services is for your personal, non-commercial use only. You agree not to use, copy, display, distribute, modify, broadcast, translate, reproduce, reformat, or otherwise exploit any BoostMyReferral content unless expressly authorized by us.
b. Violation of License Terms
Any violation of the license provisions may result in the immediate termination of your right to use the Services and could lead to legal action for infringement of copyright or other IP rights.
BoostMyReferral License to Your Content
By submitting your content to BoostMyReferral, you grant us an irrevocable, perpetual, worldwide, non-exclusive, fully paid, royalty-free, assignable, sublicensable, and transferable license to use, copy, display, distribute, modify, and create derivative works from your content. This includes use in any media now known or developed in the future, for purposes such as API partnerships with third parties. You also grant us the right to use your name or username in connection with your content. By submitting content, you waive any moral rights or claims to attribution in connection with your content.
Representations Regarding Your Content
a. Responsibility for Your Content
You are solely responsible for your content and represent that you either own the rights to it or have received explicit permission from the rights holder to submit it. You warrant that your content does not infringe upon the rights of any third parties and that it is truthful and accurate.
b. Reviews and Content Integrity
If your content is a review, you represent that it is based on your actual experience, that you were not compensated for posting it, and that it reflects your honest opinion.
Content Removal
We reserve the right, at any time and without prior notice, to remove or block access to any content that we find objectionable or in violation of these Terms. We are not obligated to return any content to you, and we may also remove images and pictures from listings at our discretion.
Customer Reviews
a. Reviews and Ratings
Customer reviews and ratings on BoostMyReferral represent the personal opinions of the individuals submitting them. These reviews do not reflect the opinions or views of BoostMyReferral.
b. Disputes Over Reviews
If a review is found to violate our policies, we reserve the right to remove it at our discretion.
Disclaimer of Warranties, Limitation of Liability, and Indemnification

YOU ACKNOWLEDGE AND AGREE THAT THE SERVICES PROVIDED BY BoostMyReferral ARE OFFERED AS IS" AND "AS AVAILABLE." YOUR USE OF THESE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BoostMyReferral, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, BRANCHES, SUBSIDIARIES, AND LICENSORS ("BOOSTMYREFERRAL PARTIES") DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES, INCLUDING ANY MOBILE APPLICATIONS AND YOUR USE OF THEM.

The BoostMyReferral Parties make no representations or warranties regarding the accuracy, completeness, reliability, or availability of any content or information provided through the Services. You acknowledge and agree that your use of the Services is at your sole risk. BoostMyReferral and its affiliates disclaim all liability and responsibility for:

  • Errors, inaccuracies, or omissions in content provided through the Services;
  • Personal injury or property damage arising from your access to or use of the Services;
  • Unauthorized access to or use of our servers and any personal data stored within them;
  • Service interruptions, transmission failures, or temporary unavailability of the Services;
  • Malicious code, viruses, Trojan horses, or similar issues transmitted by third parties through the Services;
  • Loss, deletion, or corruption of your data or content stored within the Services;
  • Any content posted, emailed, or transmitted through the Services that may be inaccurate, harmful, or otherwise objectionable.

You alone are responsible for your interactions with other users and third parties via the Services.

No advice or information, whether oral or written, obtained by you from BoostMyReferral or through the Services shall create any warranty not expressly stated in these Terms.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BoostMyReferral, its affiliates, or their respective officers, directors, employees, agents, subsidiaries, or licensors ("BoostMyReferral Parties") be liable to you or any third party for any damages, including but not limited to:

  • Errors, mistakes, or inaccuracies in the Services’ content;
  • Personal injury or property damage of any nature resulting from your use of the Services, including mobile apps;
  • Unauthorized access to or use of our servers or your personal information;
  • Delays, interruptions, or cessation of transmission to or from our Services;
  • Viruses, malware, or other harmful components transmitted through third-party actions;
  • Loss or damage of data, content, or files as a result of your use of the Services;
  • Any other losses or damages arising out of your access to or use of any content available via the Services.

IN NO EVENT SHALL THE BOOSTMYREFERRAL PARTIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES WHATSOEVER, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS.
Indemnification

You agree to indemnify, defend, and hold harmless BoostMyReferral, its affiliates, and their respective officers, directors, employees, agents, affiliates, branches, subsidiaries, and licensors ("BoostMyReferral Parties") from and against any third-party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with:

  • Your Content: Any content you submit, post, or transmit through the Services provided by BoostMyReferral. By submitting or sharing content, you grant BoostMyReferral the right to use, modify, and display it in accordance with the platform's functionality.
  • Unauthorized Use: Any unauthorized use of the Services or any products or services offered or advertised on BoostMyReferral. This includes, but is not limited to, accessing the Services through unauthorized means, attempting to exploit the platform in an unlawful manner, or using the Services for fraudulent activities.

BoostMyReferral reserves the right to take appropriate action, including termination of your access to the Services, in the event of such breaches.

We retain the exclusive right to settle, compromise, and pay, without your prior consent, any and all claims or causes of action brought against us. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter in which we are named as a defendant and/or for which you have indemnity obligations without our prior written consent. Termination of Your Access to the Services

We may terminate your use of the Services and deny you access to the Services at our sole discretion, for any reason or no reason, including but not limited to:

  • You agree that any termination of your access to the Services may be effected without prior notice.
  • We may immediately deactivate or delete your account and all related information and/or bar any further access to your account or the Services.
  • If you use the Services in violation of these Terms, we may, at our sole discretion, retain all data collected from your use of the Services.
  • You agree that we shall not be liable to you or any third party for the discontinuation or termination of your access to the Services.
Interpretation:

The section and subject headings in these Terms are included for reference only and shall not be used to interpret any provisions of these Terms.

Pricing and Payments

The prices of our services are displayed on the BoostMyReferral platform and may change from time to time. Pricing may vary based on several factors, including but not limited to:

  • Applicable promotions, discount codes, or referral-based incentives;
  • A user’s available credits or rewards on the platform;
  • The user's geographic location at the time of use or their declared country of residence when creating an account;
  • The selected currency for payment;
  • Applicable taxes based on jurisdiction or location.
Payments

By purchasing any service through BoostMyReferral, you agree to pay all applicable fees associated with that purchase. To facilitate these transactions, you may be required to provide personal and financial information (such as your name, billing address, and payment method) either directly to us or to our authorized payment processing partners.

You authorize BoostMyReferral and its partners to charge your debit card, credit card, mobile wallet, or other applicable payment method for all purchases made through the platform.

Failure to complete payment may result in cancellation of access to the services, and BoostMyReferral reserves the right to restrict or revoke access until any outstanding payments are resolved.

Severability:

If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a judicial court for any reason, then that provision shall be deemed severed from these Terms, and the remainder of the Terms shall continue in full force and effect.

Partnership or Agency:

None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and BoostMyReferral, and you shall have no authority to bind BoostMyReferral in any form or manner whatsoever.

Governing Law/Waiver:

For customers residing in India: These Terms shall be governed by the laws of India. The courts of New Delhi shall have exclusive jurisdiction over any dispute arising under these Terms.

Legal Action Timeframe:

You must commence any legal action against BoostMyReferral within one (1) year after the alleged harm initially occurs. Failure to commence the action within that period shall forever bar any claims or causes of action regarding the same facts or occurrence, notwithstanding any statute of limitations or other law to the contrary. Within this period, any failure by BoostMyReferral to enforce or exercise any provision of these Terms or any related right shall not constitute a waiver of that right or provision.

Carrier Rates May Apply:

By accessing the Services through a mobile or other device, you may be subject to charges by your Internet or mobile service provider. It is your responsibility to check with your provider to understand any potential costs incurred.

Notice of Copyright Infringement

If you believe that your copyrighted work has been infringed upon on BoostMyReferral, please follow the procedure below to file a notification:

  • Identification of Infringed Work: Provide a written description of the copyrighted material that you claim has been infringed.
  • Identification of Infringing Material: Specify the material on the Services that you allege is infringing upon your copyrighted work, including sufficient information to locate the alleged infringing material (e.g., the specific page URL).
  • Good Faith Belief Statement: Include the statement: "I have a good faith belief that the use of the content on the Services as described above is not authorized by the copyright owner, its agent, or law."
  • Accuracy and Authority Statement: Include the statement: "I swear under penalty of perjury that the information in my notice is accurate and I am the copyright owner or I am authorized to act on the copyright owner's behalf."
